Company Description

Lex Favios, Advocates & Solicitors is seeking a detail-oriented and commercially astute Associate to join our Banking Team. The ideal candidate will have prior experience in a law firm and a strong foundation in banking and finance matters, including conducting Title Search Reports, reviewing and drafting loan documentation, and advising on secured lending transactions. The role demands precision, responsiveness, and a sound understanding of legal and regulatory frameworks governing banking operations in India.

Key responsibilities shall be as under:

Title Search & Due Diligence

  • Conduct title due diligence for various types of properties (agricultural, residential, commercial, industrial)
  • Prepare and vet Title Search Reports and Property Due Diligence Notes
  • Liaise with local counsel for verification of land records and encumbrance certificates
  • Identify risks and encumbrances affecting the lender's security interest

Loan Documentation & Transaction Support

  • Review and draft loan agreements, sanction letters, facility agreements, and security documents (mortgage deeds, hypothecation agreements, pledge agreements, etc.)
  • Assist in structuring and documenting secured and unsecured lending transactions
  • Coordinate with lenders, borrowers, and internal teams for transaction closure

Regulatory & Compliance Advisory

  • Advise on SARFAESI Act, Transfer of Property Act, and other relevant banking regulations
  • Support clients in complying with registration requirements under CERSAI, ROC, and stamp duty laws
  • Monitor timelines for perfection of security and post-disbursement compliance

Qualifications & Skills

  • LL.B. from a reputed law school;
  • 13 years of experience in a law firm's banking or real estate practice
  • Strong drafting and analytical skills
  • Familiarity with land laws across key Indian states
  • Ability to manage multiple transactions and deadlines
  • Excellent communication and client-handling skills
  • Proficiency in MS Word and Excel for documentation and reporting

Preferred Exposure

  • Lending transactions involving NBFCs, banks, and financial institutions
  • Real estate financing, project finance, and structured finance
  • Title diligence for large land parcels and commercial assets
  • Working knowledge of stamp duty and registration laws across jurisdictions
