The candidate will be responsible for end-to-end management of all litigation filed against the Bank. The candidate will be responsible to co-ordinate with external counsels, internal stakeholders & authorities ensuring timely handling, defending and reporting of the cases.
Key components of the job
- In house drafting of notices/replies, petition, complaints, policies, processes, etc
- Handle and manage all litigation filed against the Bank across all forums, tribunals and quasi-judicial authorities.
- Will be responsible for all the cases post receipt of the notices/summons till final disposal of the case, including post order compliance.
- Strategize and defend the matters in co-ordination with the respective business units.
- To collect, collate and verify the required documents to defend the matter from the stakeholders.
- Seek relevant information / facts/ grounds from the concerned stake holders to defend the allegations.
- Should coordinate between the internal stake holders and lawyer to ensure accurate and consistent representation of facts in the matter.
- Ensuring timely analysis of the cases, strengths, identification of risks and formulation of strategy in consultation with seniors / lawyers on defending the matter/ out of court settlement.
- Identify and manage advocate/law firms and other legal vendors.
- Co-ordinate with the lawyer/ POA holder in getting the required replies/ affidavits filed within TAT.
- Tracking and monitoring cases which are filed, maintaining proper records/ copies of the petitions / One pagers/ replies/ WS/ Affidavits etc./ classification of the cases and periodic reporting
- Attending court cases and other regulatory offices as and when required
- To Attend the Court proceeding as a representative of the bank under POA.
- To publish timely reports /MIS, month on month basis with the development of cases filed and pending therewith in the Courts.
- To report/inform details of any adverse orders passed against the Bank and or any cases filed against the Senior Management/High value/risk / Sensitive matters to Seniors.
- Coordinating/ drafting / vetting of petitions / filing of appeals within the limitation periods.
- Maintaining billing details of lawyer, verifying bills, processing of bills.
Job Qualification:-
Academic qualification: Law Graduate.
Expected Grade: - SM/ AVP
No of years Experience: 08-10 Years
Key skills required:-
- Understanding of Banking policies and practices
- Strong understanding of Civil & Criminal laws with respect to litigations pertaining to Banking
- Eye for details and good learning acumen
- Good analytical, drafting & communication (verbal and written) & inter personal skills.
- Good working knowledge of MS office including MS Excel
- Zeal to succeed and must win attitude
