Job Description

Position Description

The purpose of this role is to manage internal stakeholders, updates, notice management systems, assist in handling highly critical litigation involving the company and its various stakeholders. The role involves assisting team in developing litigation strategy, engaging external counsels having subject matter expertise, ensuring adequate documentation etc. to safeguard the interest of the company and its stakeholders.

  1. Key Responsibilities & Accountabilities

  1. Litigation Management
  • Responsible for managing dashboards, notice management systems, assisting team in handling highly critical litigation involving company and its stakeholders.
  • Responsible for supporting and developing litigation strategy to safeguard the interest of the company and its stakeholders.

  • Draft and review various pleadings, on behalf of the company, to be filed before the courts and tribunals.
  • Conduct comprehensive research on various legal propositions / arguments in support of the company's position.
  • Support in preparing synopsis, arguments and submissions to be presented before the court and tribunal.
  • Attend court hearings and keep track of day-to-day developments in the matters and ensure that there is no delay causing and prejudice to the interests of the organization.
  • Handle pre-litigation issues like drafting notices, replies to notices received by the company etc.
  • Explore different dispute resolution mechanisms to resolve legal issues efficiently.
  • Negotiate settlements and agreements in the best interests of the company for closure of unwarranted litigation.
  • Ensuring timely reporting of litigation update to senior management, statutory authorities etc.,
  1. Legal Advice, Constructive Consultation and Risk Assessment
  • Provide legal support and advice on wide range of issues primarily on the issues related to or interpretation of guidelines, rules, licenses granted by Department of Telecommunication (Ministry of Communication), Ministry of Information and Broadcasting or any other authority, orders / regulations / recommendations / consultation papers issued by TRAI or any other authority.
  • Analyze the merits of the cases for the purposes of risk assessment.
  • Review and comment on draft bills / regulations / policies and build strong legal & regulatory narrative.
  • Support finance for addressing queries from auditors, statutory authorities etc., in relation to litigation.
  1. External Counsel Collaboration
  • Identify and maintain database of external counsels basis their subject matter expertise.
  • Maintain relationships with external law firms and counsels representing the company and ensure that company is adequately represented before the court or tribunal.
  • Participate in discussions with external counsels to develop case strategies and preparation of case hearing.
  • Manage invoices and dashboards on monthly basis.

  1. Knowledge, Certifications and Experience

Education Qualification

  • LLB

Total Experience

  • 8- 10 years of experience with relevant experience in court practice and litigation management especially litigation related to regulated sector like telecom

  • Excellent knowledge of Indian Constitution and other legislations, including but not limited to Telegraph Act 1885, Telecommunication Act 2023, Telecom Regulatory Authority of India Act 1997, Information Technology Act 2000, Competition Act 2002 etc.,
  • Well conversant with rules and procedures of Supreme Court, High Court and Tribunal.
