Job Profile:-

Key Responsibility Areas:

• Conducting Due diligence of the documents, raising requisitions to the concerned Business Teams and collating all the required information;
• Drafting of Notices under provisions of various Acts;
• Drafting of Pleadings to be filed in various Courts;
• Briefing Advocates & Solicitors and Counsel;
• Assisting Advocates & Solicitors and Counsel;
• Attending hearings at qausi Judicial Officers, Trial Court as well as High Court, and appearing and arguing the matters before them;
• Reporting the Business Team post hearing of the matter; and
• Preparing Dashboard summary of the Pending Litigations, Status update and the way forward.

JobDescription:

• Drafting letters/ applications to be made to MCGM and other authorities, as well as drafting replies to be given to MCGM and other authorities in response to the legal notices;

• Drafting of Affidavit-in Replies against the pleadings filed by the other side, may it be private entities or Corporation, before Small Causes Court and High Courts;

• Drafting of Appeals, First Appeals for challenging the order passed by Trail Courts, especially in relation to Property Tax matters.

• Deciphering the information/ liability of the company from the order passed by the Trail Courts and preparing the Dashboard summary on the same.

• Filing of Summary suit under Order XXXVII, Rule 2 of the Code of Civil Procedure, 1908. Serving of legal demand notice, preparation & filing of plaint for recovery of outstanding payment. Interacting with solicitors to get the summons issued and served upon the Defendants. Follow up with Advocate(s)

• Drafting of Statement of Objections/ written statements etc. towards consumer complaints filed against the Company under the Consumer Protection Act 1986.

• Briefing Advocates & Solicitors as well as Counsel and assisting them during the hearing of the matters with the supporting judgments/ case laws.

• Drafting of commercial documents like Memorandum of Understanding (MOU), Commercial Agreements, Leave and License Agreements etc.

• Advise the Company on various issues including statutes, government regulations and contractual obligations.

• Periodically preparing and updating the Dashboard summary of the Pending Litigations, Status update and the way forward

• Conduct legal workshops and make presentations to provide guidance and training on ensuring legal compliance to various business functions.

Requisite Qualification:-

Essential: Graduate in any discipline with LLB

Preferred: Mumbai. (Member of Bar Council of Maharashtra & Goa)

Requisite Experience:-

Essential: Practicing Advocate for at least 5-7 years of Litigation practice

Preferred: Property Tax related and other Real Estate related Litigation

Special Skills Required:-

Essential:

1. Computer Savvy;

2. Knowledge on Property laws, BMC Act, Landmark judgments in relation to Property Tax (Rateable value and Capital Value);

3. Hands on experience in litigation practice, especially relating to property tax matters;

4. Researching abilities regarding legal issues; and

5. Well conversed with reading Marathi documents;
