About the Role
The Legal Manager – Recovery & Resolution will be responsible for managing legal recovery actions for delinquent, Non-Performing Asset (NPA), and written-off loan accounts. The role focuses on maximizing recoveries through legal remedies, enforcement actions, litigation management, negotiated settlements, and coordination with internal and external stakeholders.
The incumbent will ensure compliance with applicable laws including SARFAESI Act, DRT proceedings, Insolvency & Bankruptcy Code (IBC), Civil and Criminal remedies, and RBI/NHB regulatory guidelines while driving effective recovery strategies.
Key Responsibilities
1. Recovery Management of NPA & Written-Off Accounts
- Manage recovery of defaulted Housing Loans, Loan Against Property (LAP), and other secured loan accounts.
- Develop account-specific recovery strategies based on borrower profile, security value, litigation status, and recovery feasibility.
- Monitor delinquent accounts and initiate legal recovery actions.
- Drive achievement of recovery targets through legal interventions and settlement mechanisms.
- Review high-value stressed accounts and recommend appropriate recovery actions.
2. SARFAESI Proceedings
- Initiate and manage proceedings under the SARFAESI Act.
- Draft, vet, and issue:
- Demand Notices under Section 13(2)
- Possession Notices under Section 13(4)
- Sale Notices and Auction Notices
- Coordinate symbolic and physical possession of secured assets.
- Liaise with advocates and agencies to obtain Section 14 orders from District Magistrates/Chief Metropolitan Magistrates.
- Supervise auctions and ensure statutory compliance.
- Address borrower objections and representations under SARFAESI provisions.
3. Litigation & Court Management
- Handle litigation matters before:
- Debt Recovery Tribunals (DRT)
- Debt Recovery Appellate Tribunals (DRAT)
- Civil Courts
- High Courts
- NCLT/NCLAT
- Consumer Forums
- Criminal Courts
- Coordinate with empanelled advocates for drafting, filing, hearings, and case follow-up.
- Review pleadings, affidavits, petitions, written statements, and rejoinders.
- Maintain litigation MIS and track case progress.
- Ensure timely filing of replies, evidence, and compliance documents.
- Draft and respond to legal notices.
4. Recovery Through Negotiation & Settlements
- Negotiate settlements and One-Time Settlement (OTS) proposals with borrowers.
- Assess settlement proposals considering recoverability, legal risks, and business impact.
- Facilitate execution of settlement agreements and monitor compliance.
- Recommend compromise settlements as per company policy.
5. Asset Possession & Enforcement
- Coordinate repossession and enforcement actions through authorized officers and recovery agencies.
- Ensure legal compliance during possession and auction proceedings.
- Manage valuation, publication, and sale of secured assets.
- Coordinate with police authorities and enforcement agencies when required.
6. Stakeholder Management
Coordinate closely with:
- Collections Teams
- Credit Teams
- Operations Teams
- External Advocates
- Recovery Agencies
- Auctioneers
- Government Authorities
Additional responsibilities include:
- Providing legal guidance to branch and recovery teams.
- Supporting audits, vigilance reviews, and regulatory inspections.
7. MIS & Reporting
Prepare and maintain:
- Recovery Status Reports
- Litigation Trackers
- SARFAESI Action Reports
- Ageing Analysis
- Recovery Forecasts
- Legal Recovery Dashboards
Responsibilities include:
- Maintaining records of court cases, notices, possession status, and auction outcomes.
- Analyzing recovery trends and recommending process improvements.
- Updating litigation and legal action details in company systems.
Additional Responsibilities

- Handling skip-tracing and difficult recovery matters.
- Advocate and vendor empanelment.

Required Experience
Candidates must have 5–12 years of experience in:
- Legal recovery and collections.
- SARFAESI proceedings.
- DRT matters and secured asset enforcement.
- Litigation management related to loan recovery.
- Banking, Housing Finance Companies (HFC), NBFCs, or Asset Reconstruction Companies (ARC).
Prior experience with a Bank, HFC, NBFC, or ARC is mandatory.
