Position Overview:
- We are seeking an experienced and dedicated Legal Head to join our team on an exclusive retainer basis. The successful candidate will represent our company in various legal matters in court cases ranging from financial and supply chain disputes to disputes involving title transfers of land and assets. The ideal candidate will possess extensive knowledge of the Insolvency and Bankruptcy Code (IBC) and have experience with National Company Law Tribunal (NCLT) cases.
Key Responsibilities:
Case Management and Compliance:
- Keep track of cases, proceedings, and suits, draft and file petition before the Hon'ble Court, reply and rejoinders if any on case-to-case basis, updating the status of pleadings regularly.
- Manage litigation and disputes, including working with external legal counsel when necessary, and overseeing litigation processes from initiation to resolution.
- Liaise with local administrative and judicial officials, as well as tribunal officials such as Official Liquidator, Court Receiver, etc. for all purposes of filing of petitions before the Hon'ble Civil Courts/High Courts etc.
Legal Representation:
- Represent and appear on behalf of the company in relevant court cases.
- Provide expert legal advice on title search in line with the prevalent land laws in states of Telangana and Andhra Pradesh or otherwise and support on matters related to the Insolvency and Bankruptcy Code (IBC), and relevant National Company Law Tribunal (NCLT) proceedings.
- Develop and implement legalstrategiesto protect the company'sinterests and ensure compliance with applicable laws and regulations.
- Invoke Arbitration and draftstatement of claims, written statements, establishing the points of reference and cross examination etc. including but limited to filing of petitions under section (9) in terms of Alternate Dispute Resolution
Legal Documentation and Contract Management:
- Draft& review all applications/petitions, and negotiate legal documents, agreements, and contracts to ensure the company'sinterests are adequately represented and protected.
- Draft case papers, petitions, affidavits, applications,repliesto legal notices, written statements, submissions, evidence, agreements, MOUs, etc.
Corporate Governance and Advisory:
- Advise the Board of Directors on key managerial and corporate governance issues.
- Stay updated on changes in laws and review their impact on the organization, highlighting important implications to management.
- Inform concerned departments of legal statuses related to activities and cases.
Candidate Profile:
- Bachelor's degree in law (LLB) from a Tier I orII law institute preferably from NLU or NALSAR; a master's degree in law (LLM) or equivalent will be an added advantage.
- Minimum of 15+ years ofrelevant legal experience in litigation and corporate law with 7+ years of experience with NCLT cases.
- Proven track record ofsuccessfully representing clients in court casesrelated to financial and supply chain disputes.
- Strong legal acumen and exposure to the working of courts in India.
- Familiarity with legal issuesspecific to the manufacturing industry
- High degree of professional ethics and integrity.
- Strong analytical, research, and problem-solving skills.
- Excellent written and verbal communication skills.
- Ability to work independently andmanage multiple taskssimultaneously.
- Strong negotiation and interpersonal skills.
- Language: Command over English, Telugu, and Hindi.
- Comfortable in travelling to represent the company on a Pan-India basis.
- Candidates with prior experience in contractsin in-house teamsis preferred
- Experience in handling legal mattersrelated to the power sector is preferred
- Membership in the Bar Council of India.
