To suggest and provide inputs on estate plan/ trust structuring pertaining to Estate Planning division;
Documentation work including drafting trust deeds, amendments to the trust deeds, mandate letters, NDAs and other ancillary documentation with respect to Estate Planning division;
To discuss and finalize the trust deed/s and other ancillary documentation with the client and their legal and tax counsels;
To conduct diligence on the company where shares proposed to be transferred are promoters shares and to review & provide inputs of SHA/SPA/deed of adherence and other documents which may be required from investors for limiting the liability of the trusts;
To review and provide inputs on title documentation pertaining to the immovable properties proposed to be settled into the trust/s including finalizing the sale deeds and ancillary documents and coordinating in registration of the sale deed;
To review and provide inputs on the documents (inter-alia PMS Agreement, Assets Advisory Agreements, subscription forms and letters) pertaining to investments from the trust;
To draft/ review and finalise documents pertaining to lending/borrowing/ security creation by/from the trusts.
To coordinate with the business team, tax team and operations team on finalization the trust documentation and various transactions envisaged through the trust/s;
To research on various laws and regulations impacting the estate planning structure of the client and address client's queries (inter-alia Indian Trusts Act, Companies Act, 2013, Succession Act, Transfer of Property Act, Stamp Acts, FATCA, SEBI Regulations etc.);
To review and update from time to time the processes for various activities of Estate Planning division.
