Job Description

Purpose of the Role-

The role is responsible for partnering with the Sales, Service, Marketing, Spares and Network Development functions of Tata Motors Commercial Vehicles to provide proactive legal and regulatory support. The position focuses on derisking sales and marketing operations, ensuring compliance across all customer-facing and channel locations, reducing litigation exposure, and facilitating ease of doing business while enabling business growth.

Job Responsibilities-

  • Act as a legal business partner, provide legal, issue to Sales, Service, Marketing, Spares and Network teams, providing pragmatic and timely legal advice, guidance, legal memos and support regarding contract interpretation, compliance, and risk assessment.
  • Proactively identify legal, regulatory and commercial risks in sales schemes, dealer operations, customer engagements and marketing initiatives (including marketing communications, advertisements and promotional campaigns - ensure that various mailers, newspaper advertisement, leaflets, flyers etc. are as per law in order to protect the brand image/ reputation of the Company and reduce the risk of monetary fine which may be imposed in case on non-compliance of law, particularly the Legal Metrology Act, 2009, Competition Act 2002 and digital and advertising laws).
  • Draft, review and negotiate various commercial contracts, such as vendor agreements, consulting agreements, service agreements, and non-disclosure agreements.
  • Coordinate, liaise and Manage external advocates and law firms to ensure effective legal advice and support for topical projects on a case to case basis.
  • Develop standard templates, SOPs and playbooks for routine commercial and sales-related documentation.
  • Drive simplification and standardisation of legal processes to support ease of doing business.
  • Benchmark commercial legal practices with industry peers and competitors.
  • Keeping up with current changes on all relevant areas of laws and contributing to the enhancement of the knowledge base of the company's legal function.
  • Anti-Counterfeit and Brand Protection - Lead anti-spurious and anti-counterfeit initiatives in coordination with CV (and PV, where applicable) spares teams and support enforcement actions to protect brand integrity, customers and channel partners.

We may consider including following as well. however you are requested to search mainly on above points -

• Review and approve sales schemes, dealer programs, marketing communications, advertisements and promotional campaigns.

• Handle and oversee consumer, customer, dealer, civil, criminal and arbitration matters arising from sales and distribution activities.

• Assess litigation trends and identify high-risk practices, dealers or regions and implement preventive and corrective actions.

• Examine case facts and documents to drive strong litigation defence strategy in coordination with external counsels.

Desired Candidate Profile-

• Graduate in Law (LLB mandatory); LLM preferred.

• 8- 12 years of post-qualification experience in commercial and sales-related legal roles.

• Experience in both law firms as well as in-house manufacturing or automotive organisations with a nationwide dealer or distribution network.

• Candidate who has completed or is pursuing CS or has demonstrated experience in working on corporate transactions will be preferred (although not mandatory)

• Candidate having experience in IP (trademark and copyright) matters will be preferred (although not mandatory)Skills and Competencies

• Strong knowledge of consumer law, competition law, legal metrology, contract law and litigation.

• Strong commercial acumen and business-first mindset.

• Ability to deal with ambiguity in fast-paced business environments.

• Strong communication, negotiation and stakeholder management skills.

• Process orientation with focus on simplification, standardisation and risk mitigation.

• Demonstrated ability to create legal defensive or proactive strategies
